Upholding the laws of the state of California

One of the basic requirements of the council members is to uphold the laws of the state but they often ignore this. I presented the council members a table that showed the city collected more money then is needed to pay the sewage expenses and explained the law the city violated. The city overcharged the residents by $291,000. The council members ignored the violation of California constitution Article XIII D section 6 b(1).

The following is a more complete list of the laws ignored my council members:

  • The city must provide the basis upon which the amount of the proposed fee or charge was calculated. This means the city must disclose the expenses of each fee and all parameters necessary to calculate the fee. The city does not disclose the basis.

  • Revenues shall not exceed the funds required to provide the property related service. The city had a reserve fund of $8 Million and overcharged for service.

  • The fee to each parcel shall not exceed the proportional cost of the service attributable to the parcel. Your sewage charge is not a proportional charge. The sewage is a flat rate charge. The business parcels are charge a proportional charge for sewage.

There is no public agency that going to protect the public from being overcharged for service, if the agency is the city that provides service. The council members have the responsibility to prevent the city is from overcharging for service.

Council members should not be allowed to except campaign contraptions from a business source if there is a vote on the business interests by the council.

The council members must take their oath seriously.
