AN ORDINANCE OF THE FORESTVILLE FIRE PROTECTION DISTRICT INCREASING THE DISTRICT'S APPROPRIATIONS LIMIT TO $1,500,000 FOR A PERIOD OF FOUR (4) YEARS BEGINNING FISCAL YEAR 2007-2008

The Board of Directors of the Forestville Fire Protection District do ordain as follows:

Section 1. Purpose and Intent

It is the purpose and intent of this Ordinance to authorize an increase in the appropriations limit of the Forestville Fire Protection District for fire protection and prevention services, pursuant to Article XIII B of the California Constitution. Said increase shall be effective for the four (4) year period beginning fiscal year 2007-2008. The spending limit increase will allow the District to spend the proceeds of taxes, with the appropriations to be used solely for the purpose of obtaining, furnishing, operating and maintaining fire suppression equipment apparatus, and for other necessary fire protection, prevention and emergency medical service expenses of the District. If approved, the Ordinance will serve to authorize a spending limit increase but would not impose any new taxes or increase any existing taxes.

Section 2. Appropriations Limit

The appropriations limit of the Forestville Fire Protection District is hereby increased to $1,500,000 (One Million, Five Hundred Thousand Dollars) for the four year period beginning in the fiscal year 2007-2008, in order to permit spending of the revenue raised by the proceeds of taxes for fire protection services.

Section 3. Limited Amendment

If any section of this Ordinance or portion thereof is held invalid or unenforceable by any court and such judgment becomes final, then that section may be amended by the District's Board of Directors by a majority vote to conform with the judgment of such court, provided such amendment is consistent with the purpose and intent of this Ordinance.

Section 4. Severability

If any section, subsection, sentence, phrase or clause of this Ordinance is for any reason held to be unconstitutional or otherwise invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The Board of Directors of the District declare that they would have adopted this Ordinance, and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, clauses or phrases be declared unconstitutional or invalid.

Section 5. Effective Date

This ordinance shall take effect immediately upon its confirmation by a simple majority of the voters of the District, in an election to be consolidated with the General Election held on November 6, 2007.
