Shall Section 800 of the City Charter be amended to delete the provision which required that the City Administrator prepare and submit to the City Council, and requiring the Council to adopt, the first administrative code after the Charter was established?
Impartial Analysis from the City Attorney
This measure amends Section 800 of the City Charter by deleting the current provision which required the City Administrator to prepare and submit to the City Council to adopt, by ordinance, the first administrative code after the City Charter was adopted. On June 5, 1961, the City Council adopted Ordinance No. 655 which repealed some of the existing ordinances and adopted the remainder into the Code of the City of Gilroy, California. Thus, there is no further need for the City Charter provision requiring the City Administrator to prepare the first administrative code, or for the City Council to adopt it.

Arguments For Measure K
Section 800 of the City Charter required that the City Council adopt its first Administrative Code upon approval of the Charter in 1960. The first Administrative Code was adopted shortly after the 1960 approval of the Charter. This provision was only needed at that time and serves no purpose in 1998. To aid in the Charter "clean-up", the City Council recommends you vote yes on Measure K.
